If You Ever Need Some One To Post Bail
Several things occur each day that you are not aware of, posting bail is one of those things. Possibly you have been in jail or know a friend or loved one that has been arrested, you may need to know some simple concepts.
What does it mean to post bail? When someone is arrested the court at the first formal hearing will set bail. This is usually determined by a number of factors, past record, risk to community, risk of flight, etc. The court looks at all factors and determines a figure.
For our example consider this, the judge determines bail as $100,000. In most states the accused is required to come up with a percentage of the bail amount, we will use 10% (because it's simple math). The accused or a friend would have to come up with $1,000 to get out of jail. This figure is only a partial payment of the total bail, to make sure the defendant will return for their assigned hearing date.
What happens when does not come back or misses the hearing date, then whoever posted bail is forced by contract to pay the court, the outstanding balance as damages. Because of this risk the business community created bail bondsman. A bail bondsman will assume a portion of the risk for a fee, usually 10-15% of the money put up. The higher the bail the more money the bail bondsman will make.
Since the higher the amount, the higher the risk, the bondsman may also require addition protection and may also hire a bounty hunter to go capture the running defendant. That is a completely different topic altogether.
This is a very brief overview on what is defined as posting bail, hopefully you will never need to understand this system. If you do, call a reputable bail bondsman in your county. They will be able to help get you or someone you know out of jail.
